Question:

Joe: Is this Skyauction a good company to do business with? Perhaps you could do some investigating and provide us readers with an update in a future newsletter.         When I got stuck with a worthless Braniff ticket, Amex credited my account for the cost of the ticket.  It was an advance purchase and had already been paid for.  They sent me some legal papers to sign in which I basically signed over the rights to the claim to the ticket to Amex.  I’m not saying all CC companies HAVE to do this or will do this.  But they have an interest in doing it.  In the Braniff case, they probably only got back pennies on the dollar, but I got it all back. I had a dispute with Frontier Airlines which I filed with American Express. Despite Amex’s agreeing with me that alot of what Frontier did and said was unbelievable, rude and downright untrue I still had to eat the ticket. As a general matter  any state where the company has "sufficient contacts" has jurisdiction over the company. The *law* that controls is generally that of the state where the transaction was conducted. Whether the attorney general cares or not is an entirely different matter. I would guess that you would have the most luck with your state or the state where the business is located. Caveat: I am not a lawyer (yet!) Andrew

At that time, I purchased airfare tickets from a "1-800" company guaranteeing the lowest airfare available.Great price, but like you, no tickets! After several heated phone calls and the departure date fast approaching, I called the Better Business Bureau and the State’s Attorney Generals Office(Florida) to lodge formal complaints.       Within a week, and only about a week and a half before departure, recieved the airline tickets. The BBB later informed me that they had numerous complaints against this company and it’s COO- one "Sal Esposito" !       Please let me know if he’s the same guy, so I can avoid SkyAuction.

Mike, thank you! This is very helpful. Now I know some steps I can take. Yes it is past the 60 days on my credit card. But you are right, it’s worth a try. Besides the (considerable) amount of money, it’s been awful getting messed about (I had to change my travel plans, cancel my hotel reservations etc.), stressed out, lied to, and spending a lot of time and energy over these unbelievably rude company. Depending on the date this charge first appeared on your statement you may be able to challenge it through the credit card company.  You have 60 days from the date of the statement it first appeared on to put the amount in dispute.  (Follow the wording there, it’s 60 days from the statement date on the bill it first showed up on, not thirty days, not the closing date, not the date you received the statement,  federal law states 60 days from the statement date).  This only applies if you paid with a credit card, not a Debit Card. So depending on when your bank cuts the statements and when they put the charge through you may already be past that date.  The information is printed on the back of your statement as to how to do so, don’t listen to people here who make up wrong numbers just because they like to see their own posts.  You can put an amount in dispute weather you have paid it or not.
